                               RESOLUTION NO. 19497
                  
                  
                   A RESOLUTION AUTHORIZING THE ISSUANCE OF A
                   VARIANCE FROM THE REQUIREMENTS OF ARTICLE V
                   OF THE CHATTANOOGA ZONING ORDINANCE TO
                   KRYSTAL AVIATION COMPANY TO CONSTRUCT AN
                   ADDITION TO A HANGER AT LOVELL FIELD.
                  
                                                    
                  
                  
       	    	 WHEREAS, Krystal Aviation Company has applied pursuant to
       the provisions of Article V, Section 1134 of the Chattanooga 
Zoning
       Ordinance for a variance to construct an office addition to a
       hanger at Lovell Field within the Flood Hazard District; and
       	    	 WHEREAS, the addition would be built at an elevation of
       667.00 feet above sea level and the flood elevation requirement 
at
       this point is 674.00 feet above sea level, and a variance is
       required to construct this addition at Lovell Field; and
       	    	 WHEREAS, the new addition would be compatible with
       buildings immediately adjacent to it and at the same elevation of 

       the existing taxi ways and apron area of the airport; and
       	    	 WHEREAS, by Resolution No. 14650 enacted on March 23,
       1982, the Board of Commissioners of the City of Chattanooga,
       Tennessee granted a variance to Krystal Aviation Company to
       construct additional hanger space at Lovell Field within the 
Flood
       Hazard District; and
       	    	 WHEREAS, the Public Works Inspection Division and the
       engineering office have reviewed this request and the City 
Council
       finds, based upon representations by the owner, that the owner 
has
       made a showing of good and sufficient cause for the granting of 
the
       variance, that the failure to grant this variance would result in 

       exceptional hardship on the owner requiring it to construct at an 

       elevation of seven feet above the existing structures and 
existing
       taxi ways and further that the granting of the variance would not 

       result in increased flood heights, additional threats to public
       safety, extraordinary public expense, create nuisances, cause 
fraud
       on or victimization of the public or conflict with other existing 

       local laws or regulations; and
       	    	 WHEREAS, it is determined that this variance is the
       minimum necessary, considering the flood hazard, to afford 
relief;
       and
       	    	 WHEREAS, Krystal Aviation Company is aware that there is
       some chance that damage could occur as a result of building in 
the
       Flood Hazard District;
                                 NOW, THEREFORE,
       	    	 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
       CHATTANOOGA, TENNESSEE, That a variance from the requirements of
       Article V of the Chattanooga Zoning Ordinance be and is hereby
       granted to Krystal Aviation Company to construct an addition to 
its
       hanger at Lovell Field at the Chattanooga Municipal Airport at an 

       elevation of 667.00 feet above sea level in accordance with the
       plans and specification submitted by it to the City of 
Chattanooga.
